The Disclosure and Barring Service (DBS) is the organisation that processes criminal record checks in England and Wales. The DBS also manages and maintains two barred lists – the adult’s barred list and the children’s barred list.
A barred list is a database that contains details of individuals in the UK who are not allowed to work with children or vulnerable adults due to the nature of past crimes.
How does the children’s barred list get updated?
There are two ways that an individual’s details can get added to the children’s barred list.
The first way is automatic barring which is when a person commits a crime that automatically qualifies them for inclusion on the barred list, for instance if they are convicted of a sexual or violent crime against children. In these cases, where the crimes are severe enough to qualify for automatic barring, the person has no recourse to appeal against being included on the barred list.
The second way for an individual’s details to end up on the children’s barred list is if they are referred by an employer or a regulatory body, due to the harm or potential risk of harm to children in their care or under their supervision. In this case, the role would need to be considered a regulated activity that involves direct work with children on a frequent basis. In these cases, the individual normally has the right to appeal the decision to place them on the barred list.
If a person appeals the decision by making a representation to the DBS, then they will consider the evidence from both parties and make a decision.
When should employers refer someone to the DBS for barred list inclusion?
Employers who employ people in regulated activities with children need to refer employees to the DBS for barred list inclusion if they believe that the person presents a risk of harm to children.
