These Terms of Service set out the terms on which First Job Services Ltd provides DBS checking and related application support services to individuals and organisations.

By using our website, submitting an application, or purchasing our services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

Before submitting an application, you will be required to confirm that you have read and accepted these Terms and our Privacy Policy. If you do not accept them, we may be unable to provide our services.

1. Who We Are

First Job Services Ltd (Company Number 15076484) is a UK-based organisation providing DBS checking and application support services to individuals and organisations.

We assist customers with the administration of DBS applications, including collecting information and identity documentation, checking application information, submitting applications where applicable, and providing administrative support throughout the process.

First Job Services Ltd is an independent organisation and is not the UK Government, Disclosure and Barring Service (“DBS”), Department for Work and Pensions (“DWP”), HM Revenue & Customs (“HMRC”), Jobcentre Plus, or any other government department or agency.

Where we refer to the DBS, this means the Disclosure and Barring Service. We do not control the DBS’s processing systems, search results, processing times, certificate issue dates, or decisions.

2. Contacting Us

We will contact you using the email address, telephone number or other contact details you provide when submitting your application.

You are responsible for ensuring that the contact information you provide is accurate and remains up to date.

If we require further information, clarification or documentation from you, we may contact you by email, SMS or telephone.

If you do not respond to requests for information or documentation, this may delay or prevent completion of your application.

3. Our Services

Our services may include providing access to an online DBS application, assisting with the completion and administration of DBS applications, checking information supplied by applicants, facilitating identity verification, submitting applications to the appropriate DBS processing channel, providing application updates and administrative support, and providing any additional services specifically described at the time of purchase.

The precise service provided to you will depend on the service selected and the information presented to you before payment.

Our service is an application and administrative support service. We do not guarantee that a DBS certificate will contain any particular information, that a particular result will be obtained, or that the DBS will complete an application within a particular period.

4. DBS Processing

Once an application has been correctly completed and all required information and identity documentation have been received and verified, we will process the application in accordance with the service purchased.

DBS processing times are outside our control and may vary depending on the application, the information supplied, searches undertaken by DBS and other factors.

Any processing time or completion date provided by us is an estimated timeframe unless expressly stated otherwise.

We are not responsible for delays caused by the DBS or other third parties, police forces or other authorities involved in the checking process, inaccurate, incomplete or inconsistent information supplied by you, missing or unacceptable identity documents, delays in responding to our requests, additional information being required, technical issues affecting third-party systems, fraud prevention or identity verification procedures, postal delays, circumstances outside our reasonable control, or any other matter outside our reasonable control.

5. Fast Track Services

Where a Fast Track or priority service is offered, this service relates to the priority handling or administration of your application by First Job Services Ltd.

Fast Track does not mean that the DBS, police forces or any other third party is required to process your application more quickly.

We cannot guarantee that a Fast Track application will be completed by the DBS within a particular period.

6. Your Responsibilities

You are responsible for ensuring that all information supplied to us is accurate, complete and truthful.

This includes your full legal name, previous or other names, date of birth, current address, address history, employment or other relevant information, National Insurance number, identity document information, and any other information requested as part of the application.

For DBS applications, applicants may be required to provide a complete address history covering the required period.

You must not deliberately provide false, misleading, incomplete or fraudulent information.

If information provided by you is inaccurate or incomplete, your application may be delayed, rejected, withdrawn or require further investigation.

We may refuse to process or submit an application where we reasonably believe that information supplied is inaccurate, fraudulent, incomplete or otherwise unsuitable for submission.

7. Identity Verification

DBS applications require appropriate identity verification.

You must provide the identity documents and information requested by us and follow the identity verification process applicable to your application.

We may use identity verification providers where appropriate.

You agree that information contained in your identity documents may be processed for the purposes of verifying your identity, administering your application, complying with DBS requirements, preventing fraud and fulfilling our legal and regulatory obligations.

For Basic DBS Checks, current DBS guidance requires records of documents used to validate an individual’s identity to be retained for a minimum of two years. DBS may request such records for fraud investigation or compliance purposes.

Where applicable, we may therefore retain records of identity documents, identity verification information and other application records for the period required by DBS rules and applicable law.

8. Information You Provide

You authorise us to collect, process and use the information you provide for the purposes of providing our services.

This may include personal information and identity information required to process a DBS application.

We may use relevant information as necessary to process your application, verify your identity, comply with DBS requirements, prevent fraud, provide customer support and fulfil our legal and regulatory obligations.

9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, subject to any legal, regulatory, contractual or compliance requirements.

Certain DBS records must be retained for specific periods.

In particular, DBS guidance for Basic Checks requires records of documents used to validate an applicant’s identity to be retained for a minimum of two years. The DBS guidance also requires an audit trail of applications and associated information to be maintained for at least two years in relevant circumstances.

Accordingly, information relating to a DBS application may be retained for at least two years where required for DBS compliance, fraud prevention, audit, regulatory or legal purposes.

Different categories of information may be retained for different periods depending on the purpose for which the information is held.

Where information is no longer required and there is no legal, regulatory or other legitimate reason to retain it, we will take appropriate steps to delete or anonymise it in accordance with our data retention practices and applicable data protection law.

10. Application Changes

If you need to make a change to your application, you should contact us as soon as possible.

We will make reasonable efforts to accommodate requested changes where this is possible.

However, once an application has been submitted, verified or processing has commenced, we may be unable to make changes or may need to restart or amend part of the application process.

You remain responsible for checking the accuracy of your application before submission.

11. Completion of Services

Our service may be considered completed when we have performed the service purchased from us, including where applicable processing and submitting the DBS application, completing the agreed application support, completing the identity verification or facilitating the required verification, providing the DBS application outcome or digital confirmation where applicable, or providing any other service expressly included in the service purchased.

The issue of a DBS certificate is controlled by the DBS and is not a service performed by First Job Services Ltd.

Where the DBS has completed processing and issued a result, our application-processing service will generally be regarded as completed even if you subsequently decide that you no longer require the DBS certificate.

12. Delays and Failure to Provide Information

We may request additional information or documentation where required to complete your application.

You are responsible for providing requested information promptly.

If you fail to provide the required information or documentation, your application may be placed on hold.

If the required information or documentation has not been provided within 30 days of our request, we may close or cancel the application.

Where an application is closed because the customer has failed to provide required information or documentation, any entitlement to a refund will be determined in accordance with our Refund Policy and applicable consumer law.

13. Prices and Payment

The price payable for our services will be the price displayed or otherwise communicated to you before you place your order.

You must pay the applicable fee before we are required to begin providing the service, unless we have expressly agreed otherwise.

We reserve the right to correct obvious pricing or description errors before accepting an order.

If an incorrect price has been displayed due to an obvious error, we may contact you before processing the order and give you the option to proceed at the correct price or cancel the order.

14. Acceptance of Your Order

Submitting an application or making payment does not necessarily mean that we have accepted your order.

We may decline an order where we are unable to provide the requested service, required information or documentation cannot be obtained, we reasonably suspect fraud or unlawful activity, the application does not meet the requirements of the relevant DBS process, an obvious error has occurred in the price or description of the service, you have provided materially inaccurate or misleading information, or circumstances outside our reasonable control prevent us from providing the service.

Where we decline an order before providing the service, we will deal with any payment in accordance with applicable law and our Refund Policy.

15. Refunds and Cancellation

Our refund and cancellation arrangements are set out in our Refund Policy.

Nothing in these Terms is intended to remove or restrict any statutory rights that you may have under applicable consumer protection law.

Where you are a consumer purchasing services online, statutory cancellation rights may apply. However, those rights can be affected where a customer requests that a service begins during the cancellation period and, where applicable, acknowledges the consequences of requesting early performance.

Where our service has been fully performed in accordance with your instructions, this may affect your right to cancel.

Any refund will be assessed in accordance with the service provided, our Refund Policy and applicable law.

16. Our Right to Suspend or Cancel an Application

We may suspend, refuse or cancel an application where reasonably necessary, including where information supplied is materially inaccurate or misleading, required identity documentation cannot be verified, we reasonably suspect fraud or unlawful activity, you fail to provide information required to process the application, you fail to comply with these Terms, a third-party system or regulatory requirement prevents processing, or continuing to provide the service would expose us to legal, regulatory or security risks.

Where appropriate, we will notify you of the reason for suspension or cancellation.

17. Communications

You agree that we may contact you in connection with your application using the contact details you provide.

This may include emails, SMS messages and telephone calls where reasonably necessary to request missing information, request identity documents, provide application updates, resolve issues with your application, confirm payment or order information, or provide other information relating directly to the service you have purchased.

You should ensure that emails from us are not blocked or automatically directed to your spam or junk folder.

18. Website Availability

We aim to keep our website and online application services available and operational.

However, we do not guarantee that the website or online application service will always be available, uninterrupted, secure or free from errors.

We may temporarily suspend access for maintenance, security, upgrades, technical problems or other operational reasons.

19. Intellectual Property

Unless otherwise stated, all content on our website, including text, graphics, logos, designs, software and other materials, belongs to First Job Services Ltd or is used under appropriate permission.

You must not reproduce, copy, modify, distribute, sell or commercially exploit our website content without our prior written permission, except where permitted by law.

20. Prohibited Use

You must not use our website or services for fraudulent or unlawful purposes, to submit information belonging to another person without appropriate authority or consent, to impersonate another person, to interfere with or compromise our website or systems, to attempt to obtain unauthorised access to accounts or data, to introduce malicious software or code, or in any manner that could damage our business, systems or reputation.

We may suspend or terminate access where we reasonably believe prohibited activity has occurred.

21. Our Liability

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Subject to the above, we will not be responsible for losses that are not reasonably foreseeable or that arise from matters outside our reasonable control.

We are not responsible for the actions, decisions, processing times, systems or results of the DBS, police forces, identity verification providers, payment providers or other third parties, except where responsibility for such matters cannot legally be excluded.

We are also not responsible for delays, errors or failed applications resulting from inaccurate, incomplete or misleading information supplied by you.

Nothing in these Terms affects your statutory rights as a consumer.

22. Events Outside Our Control

We will not be liable for failure or delay in performing our obligations where this is caused by circumstances beyond our reasonable control.

This may include government action, regulatory changes, DBS or police service delays, technical failures, telecommunications failures, cyber incidents, internet outages, postal disruption, industrial disputes, natural disasters, severe weather, fire, power failure, war, civil unrest, or other circumstances beyond our reasonable control.

Where reasonably possible, we will take appropriate steps to minimise the effect of such circumstances.

23. Changes to Our Services

We may make reasonable changes to our services where necessary, including changes required to comply with changes in law or regulation, comply with changes to DBS requirements or procedures, improve security, improve our systems or technology, correct technical errors, or make minor improvements to our services.

Where a significant change materially affects a service that you have already purchased and has not yet been provided, we will provide appropriate notice where reasonably practicable and explain any rights you may have under applicable law.

If you are a consumer, nothing in this clause removes any mandatory rights or protections available to you under the laws applicable to you.

Subject to any mandatory consumer rights, the courts of England and Wales shall have jurisdiction over disputes arising from these Terms.

27. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be treated as modified or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

28. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy and any additional terms specifically applicable to the service purchased, form the agreement between you and First Job Services Ltd concerning the services provided.

If there is any conflict between these Terms and mandatory statutory rights, the statutory rights will prevail.

29. Updates to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, regulatory requirements or business practices.
